Estate and Trust Planning

The firm assists clients in preparing wills, powers of attorney, health care documents and a wide variety of revocable and irrevocable trusts, as well as the filing of annual gift tax returns. We also prepare limited liability companies and partnership operating agreements to provide for family succession planning.

Estate Administration

In addition to estate planning matters for lifetime needs, Scherl Legal handles all aspects of estate administration when someone passes away. We handle the probate process, the filing of Federal and State estate and inheritance tax returns. We assist you with post mortem planning, including the filing of disclaimers, and assist the executor in all phases of the administration process until final distributions are made to beneficiaries.

Elder and Medicaid Planning

The firm helps individuals and families preserve assets in order to provide security for present or future incapacity. In addition, when facing issues of long term care and how to finance the cost of such care, whether at home or in a nursing home or assisted living facility, Medicaid becomes a critical discussion. Medicaid planning techniques will be explored, such as transfer of assets and creation of trusts, and when appropriate, the firm will assist in the preparation of Medicaid applications.

Special Needs Planning

Through the use of special needs trusts and supplemental benefits trusts, fully integrated into the family estate plan, clients may provide for a child with physical and/or developmental disabilities, as well as other special needs situations. In addition, when an individual of any age has been seriously injured as a result of an accident or medical malpractice, and a settlement or judgment in that individual’s favor becomes available, planning to protect these funds is critical. Any recovery could jeopardize that individual’s ability to continue to receive government benefits and/or affect those benefits in the future. Scherl Legal can draft the appropriate trusts and assist trial counsel when appropriate.
